Privacy Policy

This privacy policy is designed to assist you in understanding how WhitePhone Limited (“WhitePhone”) uses and safeguards Information and resources you provide whilst using the Software and Service that you have registered and selected preferences to use.

WhitePhone provides the WhitePhone Software (as more particularly described in the terms of use) (the "Software") and manages operations of the WhitePhone Service (as more particularly described in the terms of use (the "Service") and WhitePhone network which consists of Users and Publishers (the "Network").

You can register to become a user (“User”) of the Service and communicate with other WhitePhone users (“Users”) through text, voice and video communication and/or other forms of communication. Depending upon how you have configured your preferences other Users can search and find your personal and company details in our directory and add you to their online status monitor which means that they can tell if you are on line and logged into the Service.  You can invite friends to join the Service via the email search facility.

From time to time, new services may be added which improve, modify or extend the functionality of the Service.
Use of Information

We do not sell, loan, rent, trade, lease or otherwise transfer any personal information collected through the Software or Service to any third party outside the Network (except as required by law). We will treat any information you provide as confidential and will not disclose it to any third party. We will provide any information collected by us to other Users of the Service only with your explicit permission as granted by you through the preference settings that you select that are contained in the Software.  We may use any information we collect from you and about your use of the Service and dealings with us for our own credit assessment purposes.

Using Hello does not transmit any personal data to the recipient of the call (“Recipient”).  Certain information about the configuration of your PC may be provided to WhitePhone Limited and is used by us to help establish an effective connection and to prevent abuse of the Service.  We also monitor the length of the call and report this with the billing information to the Recipient.  However, your identity will remain anonymous except to the extent that you disclose it verbally during the course of the call.

The Recipient may ask you for your contact details and to opt in to receive communications from them and this opt in may give them the right to communicate with you from time to time.  If you are unhappy about these communications you should take this up with the Recipient directly.

The Service may be branded by a third party publisher (“Publisher”).  In downloading and installing the Software and using the Service under the Marks of a Publisher you have agreed to opt in to receive communications from the Publisher by any reasonable means including e-mail and text, voice and video messages regarding the Service and additional products or services which we or the Publisher may introduce.  We issue guidelines to cover such communications designed to protect Users from excessive contacts and spam and you should contact us if you are unhappy about how a Publisher is making use of this right.  We may oblige a Publisher to reduce of stop all such communications or exclude you from such communications in future. 

We may share information about you and your use of the Service with the associated Publisher and aggregate data about usage (but not personal information) to any reseller.  We will only supply such information to the extent which it is reasonable to do so to enable the Publisher to exercise its rights to communicate with you, to protect itself and its Marks from harm and to avoid excessive or duplicate communications with its customers.

In order to mitigate the costs of this Service we and the Publisher whose Marks are on the Service which you use may display advertisements to Users using the Service, and may broadcast text (with attachments), audio and video advertisements and other announcements to Users.   Your acceptance of the Terms of Use explicitly confirms your agreement to be included automatically in the list of those who have opted in to receive such advertisements as well as announcements from other Users.  You may opt out of these groups at any time by setting your preferences in the Software.

We and the Publisher whose Marks are on the Service which you use may contact you from time to time whilst this agreement subsists regarding the Service and additional products or services which we or the Publisher may introduce.  Your acceptance of the Terms of Use explicitly confirms your agreement to opt in to this right for us and the Publisher to contact you by any reasonable means including e-mail and text, voice and video messages.

Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that we shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.

A Publisher may have asked you to opt in to receive communications from them and this opt in may give them wider rights to communicate than our standard Terms of Use would.  If you are unhappy about these communications you should take this up with the Publisher directly.

Ads delivered through the Service and displayed on embedded web pages may be delivered to users by us or the associated Publisher or one of our advertising partners. Our advertising partners may set cookies or use User ID tags. These cookies or tags may allow the ad server to recognize your computer each time you download an online advertisement. In this way, ad servers may compile information about where you, or others who are using your computer, saw their advertisements and determine which ads are clicked on. This information could allow an ad network to deliver targeted advertisements that they believe will be of most interest to you. This privacy statement covers the use of cookies and tags by us and the Publisher and does not cover the use of cookies and tags by any advertisers.
Information you may provide

When you use the Service and Software you provide the following information:
Personal Information you actively choose to disclose to us
Company information you actively choose to disclose to us
Information that is provided or generated automatically during your use of the Software and
Information that you share or communicate with other Users.

Personal and company information includes data that is required to register to use the Software. This includes name, address, job title, company name and address, telephone numbers, fax number, Company logo and email address.  All this information is stored centrally by us. Personal information may also include any billing information you submit when you decide to purchase the Service from us. 

Information that is provided during your use of the Service is stored centrally and this will include details of all calls made, received and missed in order to display this information back to you through the Software.

Information that you share or communicate with other Users is limited to information that is necessary in order to provide you with the desired functionality of the Software.


Security
Communications using the Services are encrypted using 128 bit encryption.  Users are not permitted to intercept or monitor, damage or modify any communications intended for other Users.
Recording
Any call you make to us or message you send may be monitored and/or recorded for quality and security.  We do not record chat, voice and video communications which you make on a peer to peer basis and, although the Service is used to set up and monitor the connection the actual data traffic in such communications is encrypted and routed via the Internet rather than through our servers.
Messages
We will collect and store all messages including text, voice and video. If a User chooses to delete messages they can do so and they will be removed from our central system.  We may also remove messages if they become too old or exceed any reasonable storage limits we may introduce.
Chat Notes
Notes made during chat sessions when calls are in progress are stored locally and can be deleted as and when required.
No unnecessary information collected
No information concerning your computing capabilities is collected that is not related to providing the Service, including other installed software systems, non-service-related content, or hardware peripherals. No information about your specific computing facilities will be provided to any third party unless required by the terms of use of a service that you registered to use.
Protection of information

Information you provide is stored using industrial strength secure database and firewall technology and we review our security policies on a frequent basis.

As a User you need to ensure that your password is kept secret and we recommend that you change it through the facility in the application on a frequent basis.

The Software is installed on to computers using InstallShield and is downloaded from www.whitephone.com. We may also make releases available via Publishers and other trusted third parties. All downloads of the Software display the Terms of Use prior to installation and a copy of the latest Terms of Use can also be found on the WhitePhone Site.

The Software can be deleted at anytime from the computer through the Add/Remove feature that can be found in Control Panel.
Removal of Data
If you wish to have your record removed from the WhitePhone database you should send an email, text message or voicemail to support@whitephone.com giving details of your account.
Abuse

If you wish to report abuse of the Service you should send an email, text message or voicemail to abuse@whitephone.com.  We take abuse very seriously and will make reasonable endeavours to prevent actions which may harm other Users, ourselves, or the Service but, should abuse arise, our liabilities are limited in accordance with the Terms of Use.

You may not use the Service to make unnecessary or time-wasting calls, nor may you use it in conjunction in any automated manner or in any way whatsoever which does or is likely to cause harm to a Recipient.


Risks and Disclaimers
We cannot ensure or warrant that you won't receive unsolicited messages from other parties, however if you do, please contact support@whitephone.com and we will investigate the matter and, where there are valid grounds for doing so, block any offending parties. The use of Software and Service is at your own risk.
